1. Introduction

These Terms of Service (“Terms”) govern your use of the services provided by BitTrust Inc. (“BitTrust”, “we”, “us”, or “our”). By using our services or visiting our retail locations, you agree to these Terms.

BitTrust Inc. is a corporation incorporated under the laws of Canada, with its principal place of business at 4141 Dixie Rd, Mississauga, Ontario, Canada, L4W 1V5. BitTrust is registered as a Money Services Business (“MSB”) with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) under registration number M21441278.

If you do not agree with these Terms, please do not use our services.

2. Our Services

BitTrust provides the following services:

  • Virtual currency buying and selling (fiat ↔ crypto)
  • Foreign currency exchange

All services are provided in person at our retail locations in Ontario. BitTrust does not operate an online trading platform or provide custodial wallet services.

BitTrust operates on a non-custodial basis. This means we do not provide custodial wallet services or hold customer virtual currency outside the execution of a transaction, and all transfers are made directly to or from customer-provided wallet addresses.

3. Eligibility

To use our services, you must:

  • Be at least 18 years old
  • Be physically present in Canada at the time of the transaction
  • Provide valid and accurate identification
  • Not be subject to sanctions or located in a restricted jurisdiction

We reserve the right to refuse service where required or appropriate.

4. Your Responsibilities

When using our services, you agree to:

  • Provide accurate and complete information
  • Use wallet addresses that you control and verify their accuracy
  • Comply with all applicable laws and regulations
  • Not use our services for illegal or prohibited activities

Providing false or misleading information may result in refusal of service and reporting to authorities where required.

5. Identity Verification and Compliance

As a regulated business, BitTrust is required to comply with Canadian anti-money laundering and counter-terrorist financing laws.

This means:

  • You must complete identity verification (KYC)
  • Transactions may be monitored and reviewed
  • We may request additional information, including source of funds

We may delay, refuse, or report transactions where required by law or where risk concerns arise.

6. Transactions

6.1 Execution

Transactions are completed based on the agreed exchange rate at the time of the transaction and after required verification checks.

Execution times are not guaranteed and may be affected by market conditions, blockchain network conditions, or compliance review processes.

6.2 Cryptocurrency Transfers

You are responsible for providing accurate wallet addresses and selecting the correct network.

BitTrust is not responsible for:

  • Incorrect wallet addresses
  • Transfers sent on the wrong network

All cryptocurrency transactions are final and cannot be reversed once completed.

6.3 Payments

Accepted payment methods may include:

  • Cash
  • Debit

Transactions are completed only after funds are received and required checks are completed.

7. Fees and Pricing

Fees are included in the exchange rate or disclosed at the time of the transaction. Prices are subject to market changes and are final once agreed.

8. Refusal or Suspension of Service

We may refuse, delay, or suspend services where:

  • Required information is not provided
  • Compliance or regulatory concerns arise
  • Suspicious or high-risk activity is identified

In certain cases, we may not be able to provide details due to legal or regulatory restrictions.

9. Limitation of Liability

BitTrust is not responsible for losses resulting from market volatility, blockchain delays or failures, incorrect wallet details, or actions taken to comply with legal or regulatory obligations.

To the maximum extent permitted by applicable law, our liability, if any, is limited to the fees paid for the transaction.

10. No Advice

BitTrust does not provide financial, investment, legal, or tax advice. All transactions are conducted at your sole discretion and risk.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy.

12. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including technical issues, network disruptions, or regulatory actions.

13. Governing Law

These Terms are governed by the laws of Ontario and applicable Canadian laws.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of our services means you accept the updated Terms.
